Post subject:  When is a school not a school? (CC Question)

Question for you all...

If I were invited to a church service that is being held in a rented public school gymnasium on a weekend, am I still prohibited by law from carrying concealed on school grounds?

Thanks in advance

Not a lawyer, but I have carried when the facilities haven't been used exclusively by a school district. Such as a Church event, non-school district hosted function etc.

http://apps.leg.wa.gov/rcw/default.aspx?cite=9.41.280
Quote:
(1) It is unlawful for a person to carry onto, or to possess on, public or private elementary or secondary school premises, school-provided transportation, or areas of facilities while being used exclusively by public or private schools:
...
...

Of course, then there is section (6).
Quote:
(6) Except as provided in subsection (3)(b), (c), (f), and (h) of this section, firearms are not permitted in a public or private school building.

Easy answer is, who knows....

The way I read 280 is that the "while being used" only applies to the "areas of facilities" - so an example might be a school graduation event at a hall, that's not on school property. The former: premises and transportation, are off limits whether being used exclusively or not.

Which then lines up with section 6.

The main CPL exemption is to be on grounds while you pick up or drop off students. But I've always taken any school building to be off limits, no matter what kind of event is being held there.
