Did a transfer and got delayed. No biggie to me. I have a valid cpl. So even brady law says i can be given the firearm afer 4 days. Yet you tell me i have to wait 16 days for a delay?
And was told it was from the atf. No other dealer has heard of this. So why are you making up your own laws?

Well, I think they CAN make their own company rule up about if they release to you after a delay, and if so how long they wait. Right? The law requires X days, but they can do anything longer than X if they want.
It's not a law, but it's company policy, and that's okay. Some FFLs won't ever release a gun to you after a delay, assuming no response.

My concern is WCA saying it's federal law rather than just owning it as their policy. Huge difference.

That's a lot of bs, sounds like they dont want to lose business because of their policy so claim fed law. No need to lie about it and spread MORE false rumors on the interwebs regarding gun laws. Sounds like it could also be a very large misunderstanding and only one side of the story is portrayed. The OP should PM WCA on here asking for clarification and maybe stow the pitchforks, for now.

People love to say ammo can't be returned due to state and federal law too.

We don't make the laws, just follow them. We were just informed by BATF during our annual audit that I594 waiting period applies to all gun sales, with or without a CPL. We tried to argue it and the BATF agent verified this through WA DOL legal council. It is 10 business days not including weekends and holidays if there is no resolution. You can take the firearm as soon as the NICS or the State check provides a proceed. Not our fault, but we have no choice but to follow the law. Thanks for posting, Lance. So Ops got delayed on a Saturday, and the wait (assuming no proceed) is 10 business days. I assume a "business day" is M-F assuming no holidays. Therefore, he should be able to pick it up two Saturdays later, right? In this case, the delay happened on Saturday 11/28, so the gun could be picked up on Saturday 12/12 (14 days total). Is that correct? Or is there a reason that it couldn't be picked up until Monday 12/14 (16 days total)? This subject holds a lot of interest for people because the law is so completely messed up, and because we all live in fear of the damned delay....

Yes, Saturday the 12th would be 10 business days, but only because it was a NICS check, if it was a state check (no cpl on a pistol) 10 business days would be Monday the 14th. This is because the state wait is not started until Monday, LE Departments do not include weekends on their calendars, so the background check would start Monday morning. This is why we state it can be up to 16 days or more with holidays. (Clear as mud ) We do call the customer the same day we get a proceed, so the proceed in this case could happen today (because of the CPL), or Monday morning, but we will call the same day it comes through. This whole I594 debacle has been nothing but trouble for us and our annual audits cause nothing but headaches, but one thing is for sure is that we are on top of the learning curve. Be safe, Lance
