Missouri Governor — "I will pardon the McCloskeys, they won’t spend any time in jail"
Yeah, but how about not prosecuting persecuting them at first? The governor may not be able to direct the DA to file or not file charges, nor do I think that's a power they should have anyway. That's a little too much political involvement for my tastes. A pardon may be the best they can do, and it's a damn sight better than nothing. And if convicted, a pardon, if i recall, wipes the crime off the record, rather than commuting the sentence.

Governor says he will pardon. But you will prosecute anyways. Because why would you want to miss out on another chance for political theater?

Even if he pardons, if there is a conviction I think they become prohibited persons and lose their firearms rights pending rights restoration from a judge, right?

I found this for OK, I think it's state-specific and also the nature of the pardon has to specify too I think. http://www.michaelrisley.com/oklahoma-pardon-attorneyI wonder what MO is. Edit: I think you're right, in MO a pardon appears to restore rights. https://ccresourcecenter.org/state-rest ... rearms,Rev.

A right exercised incompetently isn't necessarily unlawful.
1. Criminal suit 2. Found guilty 3. Pardoned 4. Civil suit brought on by the protesters 5. Settle for damages
History suggests the couple (or their insurance company) will end up paying out to the protesters. If I were them, as soon as the criminal trial is over and they are pardoned, they pack up and head to some no-extradition country.

St. Louis prosecutor ordered crime lab to reassemble Patricia McCloskey's gunhttps://www.ksdk.com/article/news/local/gardner-staffer-ordered-crime-lab-to-reassemble-patricia-mccloskeys-gun/63-be112149-d06c-4f54-a225-6545e74b5c2dQuote: ST. LOUIS — The gun Patricia McCloskey waved at protesters was inoperable when it arrived at the St. Louis police crime lab, but a member of Circuit Attorney Kim Gardner's staff ordered crime lab experts to disassemble and reassemble it and wrote that it was “readily capable of lethal use” in charging documents filed Monday, 5 On Your Side has learned.
In Missouri, police and prosecutors must prove that a weapon is “readily” capable of lethal use when it is used in the type of crime with which the McCloskeys have been charged.

That, my friend, would be evidence tampering, in the most literal sense of the phrase.
