I think it goes back to the last registered owner...

As long as he claims it was stolen or lost....

If it isn't a registered destructive device, thief is looking at a real felony charge for just having it.

Same for the last owner if he didn't have it registered.

And, if he didn't, he probably isn't gonna be claiming it or wanting it back with the baggage that would go with it.
