New Jersey, smdh

Atlantic County, New Jersey (My9NJ) -
27 year-old Shaneen Allen from Philadelphia wanted to protect her family. She took a gun safety course, applied for and was granted a concealed carry permit and she purchased a gun.

“One of my family members, he thought it was appropriate for me to get one because I’m a single mother and I have two children and I work two jobs and I work late and getting up at that time of night I got robbed twice last year and he felt the need for me to get my license to protect me and my kids,” Allen explained.

However, while Allen was covered to carry a gun in Pennsylvania, she made the mistake of crossing into New Jersey with the weapon and now she's facing a mandatory minimum of three-years in jail.

Allen said that she didn't know her permit didn't apply to New Jersey so when she was stopped for a minor traffic offense she told the police about her gun and her permit to carry. In this case, being honest may have cost her.

“The judge tried to tell me that telling the truth messed me up, my life up and the cop said the same thing. Me opening my mouth and speaking out he said I’m one out of ten people that spoke up and was honest and that got me in trouble,” she said.

Allen was charged with unlawful possession of a weapon and possession of hallow-point bullets which were in the gun. Under New Jersey gun laws, the illegal possession of a gun is a second-degree felony which holds a minimum sentence of three-years in prison.

Allen’s Attorney Evan Nappen feels that the judge doesn't have a lot of discretion in this particular case.

“We’re talking about a law-abiding, licensed person who did nothing wrong. She is now facing three-years minimum mandatory, where the judge has no discretion, in state’s prison,” he said.

Allen has no criminal record and only owned the gun for a week. So far the Atlantic County Prosecutor has denied her entry into a diversionary program that would allow her to avoid jail time.

The case is still moving forward but the question remains, will New Jersey’s tough gun laws take a young woman who wanted protection from criminals and instead force her to become one?

Anyone that tries to convict her of a crime deserves to be in jail, in my opinion.

Sorry, She F'd up. It's bullshit that some states have such strict laws, but that is were we are right now. Ignorance of the law is not a defense. Same deal if one of us WA CPL holders goes into portland and get caught, or even a OR permit holder... She crossed a state line, a big wide one too called the Delware river. Living that close to the border (Philly) I would think her class mentioned that it was a PA permit and not nationwide. Living so close to NJ I am sure she is also aware of how draconian the laws are there. One of a few reasons I will never go back to live in the state I grew up in.

THAT SAID.. Manditory Min are a joke, and that the judge has NO leeway on a 1st offense like this is absolutely insane. Funny, how many repeat DUI offenders are probably driving that same stretch of road, but they keep getting let go on probation etc. People willfully and continually and recklessly endangering the lives of all around them, but they get let go... :cussing: :gibbs: :frust:

We live in a pretty damn good state with regards to firearms laws, crap like this I hope make everyone realise how good we have it, and reminds us all to network and do everything we can to kill i594 at the polls. Shit laws like that one are were it all starts to go down the road to become like NJ.

I hope the prosecuting attorney sleeps well at night. Probably another notch in their dildo towards becoming a circuit court judge.

That being said, the friggin cop could've given her a tongue lashing, put the fear of God in her, and let her be. She'd never carry it in New Jersey again. Now, look what they've done.

Hope they're all happy. Idiots.

HP's being a crime.. Man.. Because there are dirt berms behind every dirt bag in Jersey I guess!!
Victimless crimes as felonies....
It is sad she didn't know how poorly run a state (tyrannical) NJ is, because she should really have known her permit didn't cross state lines.
Her loss can be our gain towards a nationally recognized concealed permit perhaps. I can dream, right?

It is still against the law to pump your own gas in Jersey. There are no self serve gas stations. If you have ever been to Jersey you know why.

Jury instructions could include information about nullification. Don't make it out that the judge is backed into a corner.

I have a big blind spot in regards to any of this type of gun law.

I am completely stumped as to why a defense lawyer can't walk into court with a copy of the Bill of Rights and have the judge say "Yep. Invalid, illegal laws are not laws. Dismissed."

Not even considering my very solid pro-2A position... Just a simple reading of the most simply worded of the Natural Rights.

Sure, news items like this anger me. But they confuse me even more.
How did this happen to my country, and are the things that I am doing enough to get it back on track?

In New York it would be a felony to enter the state with an unloaded handgun fully disassembled and locked in a safe.
