Question about CA laws

I was just informed that N. Cal will be included in my territory. That means I will be driving down there quite a bit. I know my WA and OR CPLs are no good there, but can I unload my xds and put it in my suitcase while there?

I wouldn't do it personally. If you do make sure you don't take anything with capacity of more than 10, and make sure the pistol and case are locked as well. Not sure how their DOJ list of approved pistols applies to out of state travelers either. Calguns.net may have more specific legal info.

Anything more than 10 rds, either find some 10rders or take this reason to buy a new carry piece.
Look into the other dumb Cali laws about chamber indicators.
Also the ammo may have to be separately locked as well. Even if not legally so, less for any officer to bitch about.

Unloaded transportation of firearms in a locked case is ok. California forbids >10 round magazines and threaded barrels on semi-auto pistols. If your firearm has these, swap out the mags and switch out the barrel or that firearm. Mags can be loaded and kept in the same case as the pistol. It doesn't matter if your pistol is "CA compliant"

Rifles, if they have "evil features" (pistol grip, flash hider, bayonet lug, etc.) must have a bullet button installed. Also make sure mags are <10 rounds.

Does not apply to temp importation into the state by non residents. The 10 round mag limit and AW bans still apply.

You can even move there with a non rostered pistol, provided it meets the 10 round mag limit and AW bans do not apply to it. How do you think a XDm pops up in a used gun counter now and then down there? The handgun "safe" list doesn't apply to private party transfers, only to NEW DEALER SALES.

Ammo needs to be separate from the gun, but not from the magazines (no loaded mags in the gun) or case.

However, I agree with you... Keep em separate just in case of a LEO encounter, may smooth it over. All it takes is one under educated about the laws to go ahead and cuff you until they sort it out. (Not fun) :bigsmile:

I recall a case where a man got popped in Contrast Costa Co for have his AR WITH BULLET BUTTON INSTALLED in a locked case in his locked trunk, for having a banned weapon. It was the officer's mistake, but the guy ended up at least a night in the slammer.
Take every precaution necessary, and then every other one available.
Both Los Gatos and San Jose PDs have drawn on me for having a paintball gun openly displayed in my car (sitting in an open case in backseat) and once having a SWAT team show up at friends house while we had a group match on his back property. There is no cure for stupid.

I spent some time researching CA's definition of "importation" as it relates to >10 rd mags. CA law says you're ok if you have a 10rd mag (pre import ban) but it is illegal to import them.

My argument is that by driving through I am not importing because the item won't remain in California. The CA state AG site was no help, Calguns really didn't cover it well because most people are residents. I asked a friend who is a former San Diego cop and his answer was 'even if you're right your average CHP officer is going to think you are wrong, so just leave them at home and avoid the hassle'.

So my solution for my next CA road trip would be a 1911. But I hate going there anyway.
