F&#* your breath! (negligent homicide)

Another isolated incident...

Deputy accidentally shoots man, claims meant to use teaser. Man lays dying and is saying he can't breath... Deputy responds with 'fuck your breath'..


So...I see negligent homicide.. At a minimum... Maybe manslaughter depending on state law.

Then the other deputy telling the dying man' fuck your breath'? Fire his ass..

I want to know whose lcr was on the ground that the cops picked up. If the bg drew it they had every right to shoot him. If it was the officer's pistol I have a hard time imagining that being mistaken for a taser.


Either way mistakes do happen. Unfortunately when Wendy's fucks up I have to pick tomato off my burger, when cops fuck up the consequences are much more severe.

And in addition to that, he donated a lot of money and equipment to the police department, which is why they let him on patrols where he could chase, arrest, and kill people. And in 2011, he donated enough stuff that they named him 'Deputy of the Year', sort of the Kids' Choice Awards of Deputization.

McKelvey additionally noted that Bates' pistol and Taser had similar weights and both had laser sights. “He made an inadvertent mistake,” McKelvey said.

Great, more disregard for human life more disturbing unprofessional behavior and to top it off law and order wannabees get to pay to pretend to be "peace" officers. From the picture of that dude he looks like he belongs as far away from any kind of chase or struggle as possible, 73 years old? I'm surprised he didn't break his hip reaching for that gun. Ah well, just another day in New 'Murica.

I remember a Lady cop about a year or so ago shooting at a guy in a tree in Olympia.....

Has anyone ever thought if there is a tipping point where people start to say F%#k it and start shooting back . I hope it never comes to that but you have to wonder how many of these vids go by .

Only for rich old snobs that pay money and donate equipment to the department to ensure their membership as a reserve deputy officer. The old geezer had no business pulling a tazer much less a loaded weapon in a real life scenario.

Any LEO want to speak up on the use of a taser that soon after a take down?
Guy runs, gets brought down, and someone else runs up and immediately tries to tase him?

And is the LCR the suspects, an officers bug that fell out in the tackle, or the weapon that just fired?

"He shot me!". " You ran!"
Said it before...I support this idea...but it needs to be made legal.

And the "oops I thought I had my taser..." Seems to be the go to answer on many of these.
Either there isn't enough training to know one device from another...or these guys can't tell their left from their right....or they are shooting people intentionally and using plausibility as a defense.

Simply running from a LEO hardly qualifies as justification for lethal force. There can be any number of reasons to run. A person's flight or fight instinct could kick in, and you don't always have control over that shit. The LEO could be a dirtbag and you are fearing for your life. Or, you simply don't want to empower the government to have more ways to kill people and get away with it. Heck, if we are gonna give LEO's a license to kill over something as non lethal as running away, we might as well trash the entire constitution, register our guns, and let the government inspect our homes whenever they like.

Because it's for society's own good. Or whatever. I say we disarm cops and do like England, have special firearms units that are trained to use guns.

It depends on the level of resistance and the disparity of force. Both of these factors are impossible to see in the video that is currently going viral. To justify lethal force you should be able prove that there were three factors present; ABILITY (to kill or seriously injure you or another), OPPORTUNITY (to kill or seriously injure you or another), INTENT (to kill or seriously injure you or another).

My interpretation from the media coverage is that it was the weapon that was discharged by the reserve deputy officer.

Probably not a good creed to apply unilaterally to every situation where a criminal decides to flee. Leaves open too much opportunity for individual LE corruption. However, there are probably scenarios where it would be in the best interest of public safety for an officer to shoot a fleeing criminal depending on who it is, what the situation and circumstances might be.

We are all human and all humans make mistakes. There is never too much training. In this particular case and in my humble opinion, the reserve officer was certainly not trained well enough to be engaging in situations like this. Even if this 73 year old reserve officer was a retired former full time officer, he had probably been out of the game for awhile and I would presume had not received nearly the training of a full time officer.
