When engaged in surface mining, you generally need an operations plan on file, describing how you are mining and how you are going to restore the land after it's done. This is surface mining 101, and something a western miner should be familiar with. The BLM wants operation to stop until the required plan is filed. Meh.

Western mining law and land use is complicated. Current mining law requires restorative action take place after mining ends. This protects the general public from toxic and dangerous abandoned mines. It's a two way street. Extract minerals from public land, and then restore the public property when you are done.

The difference is, I can tell the difference between a good law and a bad law. Nobody is taking away the right to mine, but they are demanding the public's interest in the property be protected too.

This is all necessary because the golden rule "Don't be a dick" seems to be too vague for many people, as evidenced by our shooting pit cleanups.

It's amazing how many people will forsake their interest in public land so some greedy rancher or lazy miner can claim government oppression.

Ok I've pretty much kept nice about the BLM... Let me tell you a little bit about them fucking cocksuckers.

They have come onto my families land, land that had been OWNED, by my fucking family for over 100 years, and they have cut locks, they have ripped down gates, they have cut fence, they even fucking removed a water pump from a well used to water several troughs for our cattle.

So fuck the BLM and their little fucking cronies.

I can believe it. They tend to run towards the heavy handed. In this case with the miners though... not so much.

I'd be curious about your family land though, what the surface rights look like, etc... those can make even privately held land get weird at times, especially if it used to be range land

That I'm not sure. My great grandfathers father bought the land after moving to California in the 1890s.

Still gives them no right to do what they have done over the years.

I have zero data at all to judge what the surface and entry rights might be and if any of that can be enforced or not. I wonder if range land might be involved, because BLM usually doesn't get involved with private property. Does it abut other public land?

The far north east corner of the family property(we are talking a lot of land) backs a relative small piece of state land.

That's where they would enter the property, we had a gate there that was put in long before my time to allow fire crews into and off of the land.

Welcome to my world... Well not anymore. There haven't been any issues up there in several years luckily. We will see in the future though, my grandmother who owned the ranch recently passed, and there are talks of splitting up the land and selling it
