From the KIRO version of the story:
The judge said they had not suffered any injury or shown that they are at risk of being prosecuted.
So let's see... If LE makes it clear they intend to ignore 594, then no otherwise law-abiding person can claim they're at risk of being prosecuted. Ergo, they are NOT at risk of being prosecuted. Ergo, non-LE should also ignore 594.
Does that sound about right?

So is this an acknowledgement that 594 is unenforceable?

The ruling is interesting, both for what it does and does not say. It's short and very much worth the read.

Fuck...I need a drink.
And BTW, from his Wiki page (bolding is mine):
On January 9, 2007, Settle was nominated by President George W. Bush to a seat on the United States District Court for the Western District of Washington vacated by Franklin D. Burgess.

Someone has to get arrested for it, or threatened with arrest for it, to have standing..
IOTW, we need to have someone do a transfer in front of a cop, and get arrested, or act like they're ABOUT to do a transfer, and have a cop threaten to arrest them..
Then they'll have standing..
Because cops have said 'we won't arrest people for it', there's no imminent threat of arrest, and ergo, no standing...
Basically, it's bullshit....
