I see a lot of people (on the webs) chastising state .gov for not intercepting and shooting it down….

Serious question, do states have that ability? Is there a state vs federal airspace that gives power to the governor to intercept/eliminate a device at 60,000’ without Federal “permission”?

Doesn't matter. Feds won't enforce federal and international airspace law. Biden wouldn't protect us even if China landed troop ships on our beaches. Besides we're in a post legal society. What's Biden going to do if the Montana Air Guard shoots down Xi's balloon?

I’m kinda worried about what it contains. Shooting it to pieces might be a bad idea. They should have flown up there and slung a rope around it and towed it to Canada and let them deal with it.

SECTION 2 ORGANIZATION — DISCIPLINE — OFFICERS — POWER TO CALL OUT. ... The governor shall have power to call forth the militia to execute the laws of the state to suppress insurrections and repel invasions.

After Katrina the Fed Gov. usurped some of the authority of the Nat'l Guard from the States* (tyrannical cunts), but unless the Fed Gov specifically restricted Governor Lisply from acting, it looks like he has legal authority to act.

My guess is he would have been told to stand down had he announced his intention to intercept, but he might have gotten away with acting first and begging forgiveness later.
