So what charges could they face? Failure to summon aid. Robbery. https://app.leg.wa.gov/rcw/default.aspx?cite=9A.36.160RCW 9A.36.160 Failing to summon assistance. A person is guilty of the crime of failing to summon assistance if: (1) He or she was present when a crime was committed against another person; and (2) He or she knows that the other person has suffered substantial bodily harm as a result of the crime committed against the other person and that the other person is in need of assistance; and (3) He or she could reasonably summon assistance for the person in need without danger to himself or herself and without interference with an important duty owed to a third party; and (4) He or she fails to summon assistance for the person in need; and (5) Another person is not summoning or has not summoned assistance for the person in need of such assistance. Stress from the theft caused heart attack.... EDIT: Appears that the act is not robbery per RCW, but theft... RCW 9A.56.050 Theft in the third degree. (1) A person is guilty of theft in the third degree if he or she commits theft of property or services which (a) does not exceed seven hundred fifty dollars in value, or (b) includes ten or more merchandise pallets, or ten or more beverage crates, or a combination of ten or more merchandise pallets and beverage crates. (2) Theft in the third degree is a gross misdemeanor. I'd bet their attorney would argue that making the call would be violating the 5th since a call would place them at the scene of the crime.

I think currently you have a duty to REPORT crime and the penalty is misdemeanor. But IIRC I recently read about a push for a law to make NOT calling or actually rendering assistance for health issues a crime.

TW, thank you for looking that up! TechnoWeenie wrote: Stress from the theft caused heart attack.... But . . . was there any theft at the point that he collapsed? Or did the theft happen AFTER he fell down? I'd like to see these fuckers locked away forever, but I have a sinking feeling that it's not going to happen.

Q13 just reported they've been identified, though they aren't in custody yet.
They also said the guy in the white tank top wasn't with them, and can be heard telling the clerk 'these are not my boys'.
The boys can be charged with Burglary in the 2nd Degree, rather than just theft, because they came back.
No Good Sam law here, so no charge for not calling for help, BUT, they know the kids knew he was still alive, because he can be heard moaning when they returned.

No audio in the video, however clerk was pointing at one the kids pockets. Also eating the jerky before paying for it? Totally agree with these individuals should be facing the full extent of the law if found guilty. Please not I am impartial until I know I will not be called for jury duty and have received all the facts at trial.

See above post on the parts Q13 discussed... Please see original post video no audio, and I still hold by my view of hoping to be called for jury duty for this case and will reframe from hearing it until I know weather it is my time to go. Want to be unbiased and impartial! On a completely unrelated topic, is there still capital punishment in Washington?

According to the report/news
He saw them eating it, asked them to pay for it, they basically said 'eff you, here's a dollar' despite taking more than that, then he had a heart attack, they took their money back and decided it'd be a great time to rob the store...
Edit: mod requested.

Here’s an update in Zarif’s (the store clerk) condition from the Gofundme: Quote: Thank you to everyone who has prayed, sent good thoughts, positive messages and donated to Zarif and his family. It is uplifting to see the support of so many people.
Today is Zarif's birthday, and he is spending it in critical care. He is not able to breathe on his own yet.
However, he has opened his eyes a few times and even moved his foot! The doctors say this is a good sign.
Please continue to keep Zarif and his family in your prayers and hearts. Help spread the word!
