I didn't realize this, but the Washington State pistol application requires you to give up your HIPAA rights. I knew it was going to be part of 163whatever, but didn't know it was already part of the pistol application. A signed application to purchase a pistol shall constitute a waiver of confidentiality and written request that the health care authority, mental health institutions, and other health care facilities release, to an inquiring court or law enforcement agency, information relevant to the applicant's eligibility to purchase a pistol to an inquiring court or law enforcement agency. Has this been challenged in court before?

This should be able to be challenged in court, you should be compelled to give up your HIPAA rights

This was mentioned in one or more of the WA 2A Roundtable threads. The HIPAA violations are not new; they're just being expanded.

I will not give up my HIPPA confidentiality.....I guess i am done buying Pistols, or any semi Auto Firearm in this state.

One problem is that the younger generation doesn't care about their HIPAA rights. Privacy isn't an issue for them. They post everything on their Facebag page so who cares if the .gov has it, too?

This is the perspective we're dealing with. This doesn't apply to only HIPAA rights...these youth (most) don't care about much of any rights...other than the ability to have free speech. They don't care because they didn't have to do anything to earn them. They were earned by some earlier generation of old people...who wouldn't understand how things work today. (sarcasm) Sadly they will lose it all...including their precious free speech. My kids do not have this view...but they grew up and were raised with rural lifestyle and respect. But a lot of their friends are not that way, and generally because their parents are extremely liberal.

This is the perspective we're dealing with. Exactly. They're too busy trying to 'get' things to even fathom what they're giving up. It won't be until they have kids that there's a chance they'll realize what's happened... By then, it will be too late.

A Catch 22.
Nobody wants nut-jobs to have firearms. In all the mass shootings over the last 20 years mental health issues were involved in over 60%.
OK, so how do you keep "whack-doodles" from obtaining firearms. There has to be a way for those responsible to keep them out of these individuals hands to check their medical background (mental).
Keep the authorities locked out and those like our Tucson and Aurora, Co shooters will continue to be able to purchase firearms.
Like I said, Catch 22. Keep records sealed from law enforcement (for background checks) and have guns freely flow into these individuals hands or "Violate" HIPPA and actually prevent (at least legal sales) their acquiring firearms.
As for my medical records? Nothing to see there. Just the same old, same old, "getting old" issues. Nothing wrong in my head either.
