That's the first I have heard of such a covenant. Not to stray too far off topic, but typically in condo HOA, the deck is part of the envelope that is considered the responsibility of the HOA. The reason is usually for architectural conformity (so all railings are built the same, look the same, age the same etc), the other is because how they are attached. Bolting to the decking below, if not done correctly can then cause water damage to the structure below etc. This is usually why condo HOA's take full responsibility of the decks etc.

I agree with you but if I am the only one with access, shouldn't I be the one responsible for the upkeep?
BTW, the HOA has to approve pre rebuilds or whatever they are called.

I did a deck a while ago on a condo. Same deal. Condo owner was responsible.

We had to match all the other decks, except the owner wanted Trex. Had to paint the bottom of all the decking white so it would match.

OK, I'll play.
Front door: accessible to John Q Public
Stairs: accessible to John Q Public
Windows: inside, I clean 'em - outside, they pressure wash everything once a year - same with the siding
Deck: I'm the only one that can access it
