 AOW transfer process

I am looking at picking up a hurricane typhoon butterfly 12, I do not ya e a trust. I have a few cans but I did all that through SilencerShop with their “one shot unlimited trust” . I know I have to do a 5$ stamp but what is the turn around for AOW’s? Also do I do the paperwork for that at the FFL or is that something I need to do prior to the transfer ? Thanks in advance....

Long story short, the process is the same as a suppressor, SBR, SBS, etc, including the wait times, but with a cheaper stamp.

You fill out a form 4 to get it once the item in question is at the dealer you plan to receive it from. This may or may not be the same dealer that is selling it to you. Once the item is located at the dealer that will keep it while it's in "jail", THEN you can submit the form 4.

If your dealer is a Silencershop dealer, you can use them to fill out your paperwork, but I don't know if they can generate a singleshot trust if you didn't buy the item from them. You may have to file as an individual or make another trust.

Am I missing something? From my understanding these are AOWs because they have the vertical grip and no way to mount a hand guard. But the guy that is selling it said he bought it from Bullseye and walked out same day he paid for it. Everything I’ve searched says it’s an AOW. Am I incorrect? He said he didn’t do a trust or an individual for it.

I don't think that's an AOW. As long as it rolled out of the factory without a stock, and it's over 26" OAL, then the vertical grip should be immaterial. It's still in the same category as a Shockwave, Tac-14, and the PGO Mossberg 590 "shotguns" that you'd find at Big 5 all the time. It's a non-NFA "firearm".

To clarify, being "concealable" is an integral part of the definition of an "AOW". ATF, to be consistent with the definitions of SBS's and SBR's, has decided that "concealable" means less than 26" OAL.

If that firearm left the factory having never had a shoulderable stock attached, and an overall length of at least 26", then it is in the same legal category as a Tac-14, a Shockwave, etc. The vertical grip and ability to mount a handguard (or a lack thereof) has no bearing on this definition.

In short, that firearm, provided it is 26" OAL or greater, and has never had a stock attached to it, is not a "shotgun", not an SBS, and not an AOW. It's just a "firearm" as far as federal law is concerned.


So yes, pay the dealer, fill out the 4473, and walk out with it today.

Edit : It does have OAL of less than 26” , it comes in at 20.5”

Then yes, it is squarely in NFA territory, and maybe don't tell anybody else that your buddy walked out with one same-day without any NFA paperwork.

And are you sure it's only 20.5" long, including the brace...?

After going back and forth with seller it is 26” OAL and it does not have a brace, it has the bird head grip same as the tac14/shockwave.
