seeing as everything will be grandfathered, in your opinion, could my trust have a provision to divide my stuff evenly between current and potential future children? Or do trusts not work that way..?

I think a lawyer could word a trust to do most anything you want.
I would suggest one that actually is familiar with NFA trusts, to avoid rejection by the ATF.

Many of us did our trusts ourselves, avoiding the expense of a lawyer...

Still couldn't be transferred to another individual in this state after the ruling in regards to January 1st 1994. Grandfathered in doesn't allow transfer instate to another individual as far as my understanding.

Bottom line:
- Was published in the Federal Register on January 15, 2016
- Takes effect 180 days later, or July 13, 2016
- Was renamed to ATF-41F when it was published.

So, the clock is ticking...if you're planning on getting in any NFA purchases with your trust before the new rule takes effect, you better get on it. As awareness of this continues to grow, so will the rush on applications. There was quite a backlog at ATF a couple years ago that led to year-long wait times before approval...I foresee the same thing happening again.

Check NFATRACKER.com - the wait is already spiking. It was about 90 days over the summer - now it's up to 150 days and shows no sign of slowing down.

Is that form 1, paper, e-file?

I have only been checking paper Form 4 via a trust because that's all that I have in the pipeline (SBR x 3, suppressor x 3). But that website will show you the trends for all of them.

I am currently at:
SBR x 2 = 150 days
Suppressor x 1 = 136 days
SBR x 1 = 115 days
Suppressor x 2 = 10 days

I suspect those last two suppressors will take 200 - 250 days, if I'm lucky.

Now looking like summer / end of summer

NFATracker.com will also predict when you *should* get your tax stamp...so for example, for my first two SBRs (150 days):

The NFA Branch has a message on their phone line that just changed to say waits are now at 5 months (it previously said 4 months)...as you can see from the NFATracker graph, stuff that was submitted in mid-August is coming back now. I suspect if you submit something today - the wait will be 7 or 8 months (and growing). As we get closer to the 41P/41F deadline, the wait will likely jump to 10 or 11 months as people try to get in at the last minute.
