Anouther good guy with a gun, nah dont report that...

Tue Nov 05, 2019 10:04 pm

So a crazy guy was attacking cars on I-5 including one with woman with kids in the car. A guy i went to school with was there, held the guy at gunpoint until the police arrived, but no mention of him in the piece only "A trooper was able to stop the attacker and arrest him without any problems."

Help me understand the legal risk/defense for good guy. Was *his* life in danger? No.
At https://apps.leg.wa.gov/RCW/default.aspx?cite=9A.16.110 you can read "(1) No person in the state shall be placed in legal jeopardy of any kind whatsoever for protecting by any reasonable means necessary, himself or herself, his or her family, or his or her real or personal property, or for coming to the aid of another who is in imminent danger of or the victim of assault, robbery, kidnapping, arson, burglary, rape, murder, or any other violent crime as defined in RCW 9.94A.030."
Seems good, but what evidence did hero have the suspect was the perp? Did he observe an attempted muder (thrown object)? If so, why didn't he shoot?
Did hero have cover? (sounds like no?)
If he'd shot the perp to stop him from throwing, would it have been a "good shoot"?
Hero could have been shot by LE, what did he do to avoid that (so we can learn)?

According to what i heard from him and his family it was a situation were he confronted the guy because he thought others were in danger because he was attacking a car with children in it. So therefore justified. I've only heard the story via his facebook and his family discussing it on there. Also there were some comments on the first article from other bystanders thanking him.

By this, seems to me a justifiable shoot. Likely there was no safe backstop?

He made a citizen’s arrest, which itself was likely justified because he observed someone committing a felony.

There was no shoot, unless I missed something

Gun used to hold suspect

The question was, *if* he shot, would it be justified self defense?
Discharging your weapon while conducting a warrantless felony "citizen's arrest" might be different. I'm unfamiliar with this scenario.

Question is....
What would you do in this scenario?

Edit:
I know how I would react, very similar to what happened, and will post it after a few others respond.

Hero's actions per:https://komonews.com/news/local/freeway-attacks-terrorize-drivers-witness-shares-experience-thanks-good-samaritan-driver
"Wilde was traumatized and terrified by what happened when she called 911 to report it. She said Yates was bloody and yelling and tried to get into her car when she pulled over after being struck by debris.

But then, Wilde saw another driver stop and confront Yates. We tracked down that Good Samaritan, a Sultan man named Jacob. He told KOMO News that he has a concealed weapons permit.

“I drew my pistol," Jacob said. "I aimed it at his head because as I got closer to him, he still had this chunk of metal in his hand. I said several expletives at him, told him to get on the ground and he was under citizen’s arrest. As I ran up to him, he dropped. He dropped the metal. I went to the ground with him. As I went down with him, he jumped up and wanted to fight my father who was behind me."

He came up to help me out. I gave my father my pistol and I went toe-to-toe with the guy.”

Jacob said he tried to get Yates off the freeway.

“I backed him off I-5 down on to Pacific Avenue," he said. "I physically walked him back as he was trying to walk to I-5. My biggest thing, I didn’t want him to jump in front of a vehicle."

Troopers showed up and arrested Yates without any problems."

I can tell you what I sure as hell WOULDN'T do - go toe to toe with a guy likely strung out on meth and infected with god knows what diseases. No thanks.
