Since the FBI just told Nevada that they won't be doing private party background checks, what implications will it have here? Can Washington get the same ruling?

My first question would be if the Nevada initiative mandated the use of an existing FFL dealer to complete the transfer, or did it allow for citizens to conduct the checks themselves? If the proposed law was similar in structure to ours, the same ruling from the Fed's should apply.

Nevada is a point of contact for NICS; they do all the work themselves through their own system and so are not allowed to use NICS.

WA is not a point of contact state.

According to the article it is because the FBI would have to hire more people to do back ground checks. Who performs the checks in Washington state local/state LEO or FBI?

Maybe after the new administration is in place the new FBI budget won't have the extra money to do background checks of honest people.

The issue is they said the FBI must do X in the state bill. Can't do that.

594 said you must go to a FFL.

I think this is the key distinction between the laws in NV and WA. States can't legislate federal agencies into action.

As the law of unintended consequences continue to play out in accordance with the anti-freedom agenda, I wonder what will happen with NICS as more states adopt laws resembling 594. Will the FBI be even more overwhelmed than they already are? What will they do about it?

Maybe I don't understand this correctly, but if NV runs their own how would that make a larger burden on the FBI? If anything, shouldn't WA's UBC be even more of a burden since our system relies solely on the NICS? Maybe the FBI needs to step in here, too.
