Post subject:  10 business day wait clarification

does anyone have the letter about how background checks are to be run?

all I can find is the current rcw

Ten business days have elapsed from the date the licensed
dealer requested the background check. However, for sales and
transfers of pistols if the purchaser or transferee does not have a
valid permanent Washington driver's license or state identification
card or has not been a resident of the state for the previous
consecutive ninety days, then the time period in this subsection shall
be extended from ten business days to sixty days.

I am trying to find about business days and how agencies are supposed to do it . google sucks where I am at.

the bold part, I remember it was found before but i cant find it now


If no response to the background check is received after ten business days (starting with the business day AFTER the background check info is submitted), then the FFL legally may deliver the handgun to the buyer but is not required to do so.

As a permanent resident alien I always get delayed anyway. The AR-15 lower was like 21 days. Pistols usually 5 days. Shotguns 1-2 days.

I am looking for the document on how they do business days.

the fbi says

"A business day is any 24-hour period beginning at 12:01 a.m. the day after the check was initiated, in which state offices are open. A business day does not include Saturday, Sunday or state Holidays"

there was a state document that told how the checks where to be done.

I'm not trying to disagree with you, I'm trying to understand.

If you already know the federal definition, how would knowing the state definition change your local policies and procedures if it were different?

The 10-day wait is a state law per 594, so the state definition is relevant.

Thanks, that's what I was missing & trying to understand.

For some reason, I had it in my head that the Federal requirement was stricter, so following that meant you were good to go.

This is actually a pretty good question because it's less clear now than in the past.
Before the changes brought about by I594 it applied only to pistols when the buyer didn't have a CPL, not to delays. But more clearly it stated five business days in which state offices are open. Now it just says 10 business days. But not who's business days. The store's? The state's?

That's correct.
My former local FFL told me "I'm open on Saturday and Sunday, which are my business days, so you can pick it up next Tuesday"
So ya, I dunno. Think most FFL's go off WA state business days.

West Coast Armory in Factoria prints your pickup date on your receipt on a Delay.
Don't count the first day so you can pick it up in 15 days if no 'Proceed' is issued.
