I remember reading case law that said something to the effect that the warrant should be SERVED before entry made onto the premises, where reasonably possible.
That's why the warrant is in the hand that pushes you out of the way if you object. The warrant hits your chest first
Why all the concern over Search Warrants? Isn't everyone here "squeaky clean" and "law abiding"? If so why would any agency want to serve a search warrant on your premises????
I think we all know how easy it is to get a warrant. They're all but rubber stamped.
When I was much younger, I was renting a room. My housemates GF opened the door to a bunch of deputies, who forced their way into the house, WITHOUT a warrant (arrest, search, or bench), because her BF had outstanding bills for child support.
He was ordered to pay up (by the deputies), or go to jail, for contempt of court.
In MD, the sheriffs dept is only there for court related activities, they don't act as police...Except when it comes to being enforcers to get money out of people, apparently..
I also had a friend of mine whose car was searched illegally. She said she didn't want it searched without a warrant, so the officer came back and said he had one, but refused to show her, and ordered her out of her car. They ended up finding some prescription medication that wasn't hers, it was her dogs, in her dogs name (Ie scruffles Jones), that ONLY is used for canines. They arrested her and charged her with possessing prescription medication without a prescription.. Then claimed that she gave consent for the search, there was no warrant.
They dropped the charges after the DA found out that her dad was pretty high up in the DEA, and that they really couldn't get a conviction because their case was shit.
The 3 cars who were on scene, with dash cams rolling, that would have proved her saying she didn't consent to a search, and the officers claiming they had a warrant?? 'Malfunctioned'...
