That's exactly the text I am referring to, but if you look at the actual exemptions (fleeing felon being just one example) I think they have actually more latitude. The wood carver shooter is a great example.

So, you are reinforcing what I said. The law SAYS citizens have more latitude, but if you look at the text around police officers, they seem to have a lot more leeway (e.g. as long as it is "without malice") which is how Birk got off.

I'm not taking a CJ degree. Just one class. Needed an elective. Besides, it's full of morals and ethics and dumb shit like that. And for what I pay for lot rent, I could be renting an apartment. I like this better, and when I find a piece of property I like, instant house while building.

Maybe the cops could have just started chucking rocks back at his crazy ass, then they would probably be all good. I was involved in a lot of "chestnut wars" in my neighborhood when I was in Jr. high school and let me tell you, chestnuts are hard as shit. There were even some 'military grade' chestnuts you could scrounge if you could find them in time, the ripe kind that just dropped off the tree with the spiked green husks still on them. Those were the days...I have a few scars to prove all this. Give them what you got back, baby.

I see a lot of parallels with the Birk/woodcarver case. If Birk got off, when the woodcarver didn't actually attack him with what was a tiny folding knife he was using to wittle, then surely shooting someone hurling sharp edged rocks AT ME (I'm embellishing there) is just peachy?

Remember also the legal standard for justifiable homicide by police includes "serious physical harm" not only death.

I found some pictures online of the border patrol guys that were hit with rocks and their faces were seriously messed up. I don't know the law can distinguish between how large the rocks were, how hard and how accurately they were thrown, but the article says he was throwing rocks at vehicles. If they were moving, definitely a big safety risk to the public. There really aren't enough facts here to make any kind of reasoned judgement, and the video shows only part of it.

I'm not sure what happened prior to the video beginning but I don't think anyone has accused Zambrano-Montes of wielding anything other than rocks prior to the video starting. If this is the case than what other facts could we not have that might provide the crucial evidence to clear these officer's?

This is a hypothetical question. What could possibly make this a justifiable homicide that hasn't been proven yet? Did he call them pigs? Did he spit on them?

I can't come up with one possible explanation besides maybe he said he had a bomb strapped to him and would blow them all up. However since Zambrano-montes had problems speaking English this seems very unlikely.

How big were the rocks and was the potential injury to officers and public "serious"?
Did he still have rocks at the time he was shot? (i.e. was he out of ammo)
Was he throwing rocks at moving vehicles?
Did he still present a threat to the officers and public?

If you can tell all of that from the video, you're a superstar.
