I don't care what your reason might actually be or what excuse you might come up with. Some of the scenarios that are run thru at defensive training academies are: (1) that a homeowner is comes home to an unknown person in the closet, or (2) someone is trying to get in the front door/side window at night while people are sleeping. They explain in the first case that a daughter wanted to play a trick on her parents and snuck in and made some noises in the closet and the father pumped the closet full of lead. For the other, a guy who had too much to drink was trying to get home and in his error at night and while inebriated, tries to get in his home but for some reason he can't get in. Trouble is he is trying to get in an identical house and the homeowner thinks he's trying to break in.

Used violence ie broke a window to get in = propensity for violence, cars in driveway (assuming) means burglars knew someone was home, doesn't take a rocket surgeon for a 'reasonable person' to infer that force was gonna be used on the occupants as it had already been used to gain entry.
Good shoot.

My kids bedrooms are on the second floor, would need to climb up to the garage roof to look in.

We aren't talking about someone making noises in a closet. And the drunk... Probably drove there. And is so drunk he can't recognize this is not his own house. I just prevented a future DUI, possible death of some innocent other driver...

You're right, and that is a decision I would not want to make. Once the bullet goes out of the chamber though, there are a future of legal issues that are forthcoming. You're going to be in all the news media as a heartless gun nut who took the law in his own hands. It will be in all of the gun boards with people on both sides speculating when goes on in your head. You will spend lots of money in legal defense. You will take time off of work to work in your defense. Your life will never be the same. You may even have to move or change jobs. Choose wisely. Don't get me wrong, I would be angry too, but being angry does not lend itself into making wise legal decisions, well wise as to preserving your wealth.

There are numerous situations of 'drunk guy breaking in and getting shot',some ruled justified, some not... The devil is in the details (and the state law)..
Personally, I'm not gonna shoot unless they've gained entry or are near enough to doing so...Shooting through doors/windows is a bad idea, for many reasons.
If you're climbing in a window, you're fair game. If you've breached the door and you're making entry, you're fair game. My house is my castle. If you've broken in, you're not there for a cup of tea..

Trouble is he is trying to get in an identical house and the homeowner thinks he's trying to break in. My kids and ol lady know not to play those kinds of pranks on me luckily. I have enough training and skill set to know to identify a threat to beyond a reasonable doubt before sending lead flying. You try and kick in my door Ima let you know your fucking wrong. The wrong house. No I won't open the door. But I'm gunna light up my front porch lights like the fucking Fourth of July. And you continue to force your way in... I will go to bed with a clean conscious over my actions. And as far as some dipshit peeking through my kids window. Goddamned strait Ima walk out and confront the bastards. I will have my gun, probably including my pump gun and my dog at my side. You fuck with me or force shit to go sideways, Ima turn 50 pounds of redheaded fury loose on your ass and fill your guts fulla double ought. This is my piece of dirt, I was here first, and your creepy ass doesn't scare me, but I'll gladly be the thing that give you nightmares for the rest of your life... however short that might be.
