Individuals in most states are allowed some form of "castle doctrine".
Yet the US as a whole, is not allowed a castle doctrine???
If you called me up and asked to come and live in my house...
I might be open to negotiations, or I might not. When and why I might or might not, are entirely up to my own prerogative.
If I am not... And you come and crawl in my window, late at night, with the intention of living in my house against my will... You are likely to end up dead.
If you want to live in the US... If you make the phone call, (Start the legal immigration process)... Great. You'll make it or not.
But if you crawl in the window in the middle of the night... I think you should count yourself lucky only to be deported back where you came from.

I don't see this as 'unfair'. (To put it lightly.)
If you want to be here, do it legally.
